Never eve heard about a clause like this but it's not surprising. I would think that since the clause was added after the purchase the case should be a slam dunk. I love the blow back that is happening against Kleargear.com.

If the items were never delivered as required by the contract, wouldn't Kleargear be in breach, voiding the rest of the contract?

That would probably put Kleargear in breach, but I think you would have to see the contract to know whether other parts of the contract survive.

The non-disparagement language in that case seems like it should fail for lack of consideration since it was added after the deal was struck.
